An international group of lawyers is launching a class action on a European scale, marking the first of its kind. The devices were intended to improve sleep quality by reducing snoring and breathing interruptions, but they turned out to have a serious flaw. The insulating foam in the devices could come loose and cause injuries, leading to recalls and financial losses for Philips.
More than 1.2 million consumers, including 34,000 Belgians, have reportedly suffered damage from Philips sleep apnea devices. Among the patients affected by the faulty devices are 34,000 Belgians, who may be eligible for compensation for emotional distress or health problems.
The company has already faced billions in recalls, lost profits, and legal fees related to the faulty sleep apnea devices. A settlement was reached in the US earlier this year, but now a European class action is being pursued. An Italian law firm is taking Philips to the Milan court on behalf of the Italian consumer organization Adusbef. The lawsuit extends to the entire European Union, and patients who have used the device are entitled to compensation for various health issues.
Philips has denied any wrongdoing, and their share price actually rose after the US settlement, indicating investor confidence. However, if more patients opt to participate in the European class action following the outcome of the case, it could lead to further financial losses for Philips as well as potential changes in their business practices related to product safety and liability issues.
The legal battle over faulty sleep apnea devices continues in Europe with patients seeking redress for harm caused by defective products.
